TERMS AND CONDITIONS

1. Interpretation and Definitions Interpretation Words whose first letter is capitalized have meanings defined under the following conditions. Definitions Application: means the software program provided by the Company, downloaded by you on any electronic device. Company: (referred to as "the Company," "we," or "our" in this document) refers to GIG Alarm. Device: any device that can access the Service, such as a mobile phone or tablet. Personal Data: any information that can identify you, such as name, email, or unique identifier. User: any person who accesses or uses the Service.
2. User Account Creation and Management To use certain features of the application, users must create an account, which will be their identity within the service. Account creation and authentication is done through verification by SMS, without the need for a password. 2.1 Account Creation Process The user enters their mobile phone number. A verification code is sent via SMS to confirm the account. Once the code is confirmed, the user completes their profile with the following information: Full Name (first and last name): It can be a nickname if the user prefers not to use their real name. Email: Required for account recovery and important notifications. Date of Birth: Requested to verify that the user meets the minimum age required to use the application.
State: Requested to adapt certain aspects of the service without collecting exact location. Gender: Required to improve user experience. Options: Male, Female, and Prefer not to say. 2.2 Important Account Conditions The phone number is the unique identifier of the account and is used for authentication without the need for a password. If the user changes their phone number, they can request the change by sending an email to technical support. Once the request is received, the user will receive a confirmation link in their registered email, where they can enter their new phone number. The new number must be verified with an authentication code sent by SMS. The email can be edited within the application before requesting a number change. If the user does not have access to their registered email, they will not be able to complete the process of changing their phone number. 2.3 Modification of Account Data Users may modify certain personal data from the application settings at any time, including: Full Name Date of Birth State Gender Email Exceptions: The phone number cannot be changed after registration.
3. Sending Alarms to Third Parties
The application allows users to send alarms to third parties to remind them of important tasks or commitments. To ensure a controlled experience and prevent misuse of this functionality, the following conditions are established: 3.1 Acceptance of Alarms by the Third Party When a third party receives an alarm for the first time, they will have the option to: Accept only this alarm. The alarm will be activated only for that specific event. In future alarms sent by the same user, their acceptance will be requested again. When the third party accepts the alarm, the user who sent it will receive a real-time acceptance confirmation. Always accept alarms from this user. All alarms sent by that user will be accepted automatically without manual confirmation. This option allows, for example, a parent to send recurring reminders to their child without the child having to accept them each time. Although alarms are accepted automatically, a notification will be sent to the sender (e.g., mother or guardian) confirming that the alarm has been activated and seen by the receiver. The third party can change this setting at any time from the alarm management section. 3.2 Management of Linked Accounts To ensure proper functioning in a family or supervisory environment, the application allows the creation of linked users under the following conditions: Account relationship: Users can link accounts within the app (e.g., parents and children, teachers and students). If the user sending the alarms is linked as account administrator, the third party cannot block their alarms. Confirmation of alarm receipt: When a third party receives and accepts an alarm, an immediate confirmation will be sent to the sender. Modification of the linked user relationship:
If a third party wishes to unlink from an administrator user, they must initiate a verification process to ensure proper use of the system. 3.3 Alarm Sending Conditions The user can send an unlimited number of alarms to different third parties within the same day. The third party will receive a notification via SMS or email informing them that a user has sent them an alarm. The third party must accept the alarm before it is activated, ensuring that they agree with the notification. Mass sending of alarms or use for spam or harassment is not allowed. If a user repeatedly misuses the service, the Company may suspend or delete their account without the right to a refund, even if they have an annual subscription. The third party can exclusively modify the field "Remind me", selecting how much time in advance they wish to receive the notification. The available options include: 5 minutes before (for quick reminders like taking medication). 30 minutes before (ideal for important meetings or calls). 1 hour before (for activities that require preparation, like a medical appointment or a trip). 1 day before (for commitments that require more planning, like bill payments or important events). Custom (allows choosing an alert based on the user's specific need). The Company reserves the right to restrict the use of this functionality in case of abuse or misuse.
4. Application Operating Requirements For the application to function correctly and alarms to sound at the scheduled time, the application must remain active in the background on the user's device. 4.1 Definition of Background
This means that the application must be open and running, even if it is not visible on the screen at that moment. If the application is completely closed (forced manually or by the operating system), alarms may not sound at the scheduled time. 4.2 Recommendations to Ensure Proper Functioning Do not close the application from the recent applications or multitasking view. On devices with power-saving features, add the application to the exclusion list so that the system does not stop it automatically. Verify that the application's notifications and permissions are activated in the device settings. 4.3 Limitation of Liability Important: The Company is not responsible for alarms that do not sound due to restrictions imposed by the device's system or user personal settings that prevent background execution.
5. Subscriptions, Payments, and Cancellations The Application is free for a trial period of 7 days from the time of user registration. Once this period is over, it will be necessary to acquire a subscription to continue using the application with all its functionalities. 5.1 Subscription Conditions After the trial period, the user must choose a subscription plan to continue using the application. The number of alarms that can be scheduled is unlimited, both during the trial period and in the paid version. Subscriptions can be monthly or yearly, depending on the option chosen on the payment platform. The subscription charge will be processed through the corresponding app store (App Store or Google Play). The subscription will renew automatically, unless the user cancels it before the renewal date. 5.2 Refund Policies and Resolution of Billing Errors No refunds will be granted for already paid periods, except in cases stipulated by the policies of the corresponding app store (App Store or Google Play). If a user believes they have received an incorrect charge or a billing error, they must follow these steps:
Request a refund directly in the corresponding app store: Google Play: Through the "Request a refund" option in the Google Play account settings. App Store: Via reportaproblem.apple.com. If the refund request is rejected or the user encounters technical issues, they may contact the application support team by sending an email to [support email] with the following information: Full name of the account holder. Email associated with the account. Description of the problem. Screenshot of the incorrect charge (if applicable). Transaction reference number (if applicable). The support team will review the request within a maximum of 10 business days. If it is determined that the charge was incorrect, the support team may authorize the refund through the app store developer console, subject to the policies of Google Play or App Store. The Company will not process refunds directly, as these must be handled through the app store. If the user has acquired a subscription and wishes to cancel it, they must do so from their account settings in the app store before the next automatic renewal. 5.3 Restrictions and Exclusions: If the user does not acquire a subscription after the trial period, access to the application will be restricted. Some advanced features may be available only to users with an active subscription. Some application features may be available through paid subscription plans. By subscribing, the user agrees to the billing terms as detailed on the payment platform. 5.3 Cancellation Users may cancel their subscription at any time from the app store settings.
Once cancelled, the user will be able to continue using the application until the end of the current subscription period.
6. Communications and Notifications By registering in the application, the user agrees to receive communications related to the application and other GIG products through the following means. Communications that will be received include, but are not limited to: In-app notifications: Messages regarding updates, new features, and service improvements. Email: Information about news, updates, improvements, and other GIG products. SMS messages: Alerts sent by third parties through the application to remind about commitments or assigned tasks, security reminders, important changes to terms and conditions, and essential notifications about the account. User experience surveys: The company may send surveys within the application via notifications. The user will have the option to complete them or ignore them without affecting the use of the application. It is clarified that the surveys will be sent only within the application and the user can decide at that moment whether they wish to respond to them or not. No surveys will be sent via email or SMS. 6.1 Communication Control Options In-app notifications are a fundamental part of the service and cannot be disabled, as they are necessary for the proper functioning of alarms. If the user disables notifications, alarms may not sound or may not be received on time. The user may opt out of promotional emails, but will continue to receive notifications related to account security and access recovery. SMS messages will only be used for alarm notifications, essential and security notifications. The Company is committed to not sending excessive or invasive communications. Any attempt at abuse or misuse by third parties may be reported to technical support. Important: Surveys will be sent only within the application, and the user can decide at that moment whether they wish to respond to them or not. No surveys will be sent via email or SMS.
7. Changes to Terms and Conditions
The Company reserves the right to modify these terms and conditions at any time. Any modification will be notified to users through the application or by email, using the contact information provided in the account. Changes will take effect 30 days after notification, except in urgent cases where immediate application is required for legal or security reasons or to ensure the proper functioning of the service. In case a user disagrees with the changes, they may cancel their subscription or stop using the application before the modifications take effect. Continued use of the service after the changes take effect will be considered acceptance of the new terms and conditions.
